Terms And Conditions

Last Updated: July 16, 2026

Mighty Arm Excavation, LLC ("Mighty Arm," "we," "our," or "us") operates this website at https://www.mightyarmexcavation.com/ (the "Site"). These Terms and Conditions ("Terms") set the rules for using it, whether you are reading our service pages, requesting a bid, or reaching out about a project.
By using the Site, you agree to these Terms. If you do not agree with them, please do not use the Site.

1. Use of the Site

You may use this Site to learn about our work and to contact us. You agree not to:

  • Reproduce, alter, decompile, or reverse engineer the code or materials behind the Site
  • Strip out any copyright, trademark, or ownership notices
  • Republish or mirror our content on another platform or server
  • Disrupt the Site's operation, its security, or the networks it relies on
  • Transmit anything unlawful, deceptive, obscene, or harassing
  • Use the Site in any way that breaks local, state, or federal law
  • Distribute spam or unsolicited promotional material
  • Harvest information about other visitors without their consent
  • Infringe the intellectual property, privacy, or other rights of anyone else

2. Content Ownership

The material on this Site, including project photography, written copy, the Mighty Arm Excavation name and logo, and the underlying code, is owned by Mighty Arm or licensed to us for use here. It is protected by copyright, trademark, and other intellectual property laws.

You may view or print a single copy of a page for your own reference. This gives you no ownership of the material, and the permission ends the moment you breach these Terms.

3. Information and Materials You Provide

The information and files you send us stay yours. That covers what you enter in our contact form, the plans, drawings, and specifications you share, and any project details you provide when requesting a bid. We do not claim ownership of your documents or your project information.

By sending it, you grant us permission to use that material to act on your request, prepare and refine a bid, perform the work if we are engaged, and operate our business in the normal course. Should you give us a reference or testimonial, we may publish it on the Site and use it in our marketing. If you later want it taken down, tell us and we will remove it.

4. Project Documentation and Photography

We may document our sitework while a project is underway and after it is finished, then use those images in our project gallery, on our service pages, and in our marketing. The photos focus on the work itself: clearing, excavation, grading, and utility installation. We do not publish the property owner's name, the project address, or client contact information alongside them. If you would rather we not photograph a job, tell us before work begins and we will honor that.

5. Disclaimers and Limitation of Liability

The Site and its contents are provided on an "as is" and "as available" basis, with no warranties of any kind. To the fullest extent the law allows, Mighty Arm is not liable for:

  • The Site being uninterrupted, secure, or free of errors
  • The accuracy, completeness, or timeliness of anything published here
  • Any loss or damage arising from your use of, or inability to use, the Site

This section applies to the Site alone. It does not affect the workmanship warranty covering work we perform, which is set out in the signed agreement for that project.

6. Accuracy of Site Information

We work to keep the Site accurate, but the information on it is general and can become outdated. Descriptions of our services, project timelines, and any figures shown are illustrative rather than binding commitments. We may edit, update, or remove content on the Site at any time.

7. Links to Third-Party Sites

The Site may include links to other websites, such as our social media profiles. We do not run those sites and are not responsible for their content or practices. A link from us is not an endorsement. Once you leave our Site, your activity on any third-party site is governed by that site's own terms, which we suggest reviewing along with its privacy policy.

8. Suspension of Access

We may limit, suspend, or end your access to the Site at any time and without notice if you do not comply with these Terms.

9. Severability

If any part of these Terms is found invalid or unenforceable, that part will be narrowed or removed only as far as necessary, and the rest of the Terms will stay in full effect.

10. Governing Law

These Terms are governed by the laws of the State of Washington. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in King County, Washington.

11. Updates to These Terms

We may revise these Terms as our business or the law changes. The current version will always appear here, marked with the "Last Updated" date above. Any revision takes effect when it is posted. We recommend reviewing this page periodically.

12. Website Information vs. Project Agreements

The content on this Site, including our service pages and any guarantees or figures mentioned, is general information and does not by itself create a contract. The scope, price, schedule, and warranty for any project are governed by the written proposal or subcontract we issue and both parties sign before work begins.

13. Bidding and Pricing

We prepare bids after reviewing the project plans and specifications, visiting the site when needed, and coordinating with the general contractor or design team. Any numbers referenced on the Site are general and do not constitute a quote. We bid on a fixed-price basis, with time-and-materials pricing applied to unknown or unforeseen conditions where noted. The only binding price is the one stated in the written bid you approve, and each bid specifies how long it stays valid.
